Acceptance
By installing or using TMS Toolbox (the "App"), you agree to these Terms of Use. If you do not agree, do not install or use the App.
Intended users
The App is intended exclusively for use by trained transcranial magnetic stimulation (TMS) researchers, clinicians, and technicians who are qualified to administer TMS and interpret its results. It is not intended for use by patients, by lay persons, or by individuals without appropriate training in TMS techniques, motor-threshold determination, and scalp-based cortical localization.
Not a medical device
The App is provided as an educational, research, and calculation aid. It is not cleared, approved, or registered as a medical device by the U.S. Food and Drug Administration (FDA) or any other regulatory authority. The App does not diagnose, treat, cure, or prevent any disease or condition. It must not be used as the sole basis for clinical decision-making. All clinical decisions remain the sole responsibility of the qualified treating professional, who must independently verify any value the App produces before acting on it.
No warranty
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF DEFECTS, OR THAT ITS OUTPUTS WILL BE ACCURATE OR APPROPRIATE FOR ANY GIVEN INDIVIDUAL OR CLINICAL SCENARIO.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPERS, AUTHORS, COPYRIGHT HOLDERS, OR DISTRIBUTORS OF THE APP BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING BUT NOT LIMITED TO PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION; OR ANY CLAIM RELATING TO PATIENT INJURY, MISDIAGNOSIS, INCORRECT DOSING, OR INCORRECT CORTICAL TARGETING) ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
User responsibilities
You are solely responsible for: (a) verifying that you are qualified to use the App as described above; (b) independently confirming any output of the App against established clinical references and your own clinical judgment before relying on it; (c) any use, decision, or action you take based on App outputs; (d) ensuring your use of the App complies with all applicable laws, regulations, institutional policies, and professional standards in your jurisdiction.
Intellectual property
The App and its content are protected by intellectual-property laws. You receive a limited, non-exclusive, non-transferable, revocable license to use the App for its intended purpose on devices you own or control. You may not reverse-engineer, decompile, redistribute, or create derivative works of the App except to the extent permitted by applicable law.
Indemnification
You agree to indemnify and hold harmless the App's developers and distributors from any claim, damage, loss, or expense (including reasonable attorneys' fees) arising out of your use or misuse of the App or your breach of these Terms.
Governing law
These Terms are governed by the laws of the State of South Carolina, USA, without regard to its conflict-of-laws principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in South Carolina.
Changes
We may revise these Terms at any time. Continued use of the App after a revision constitutes acceptance of the revised Terms.
Severability
If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full force and effect.
